  • Planning Permission for Extension

    We are seeking to extend the top floor of our property. Our Community of owners has now been formed and permission will be given when we submit architect's drawings. However we do not yet have a Certificate of Habitation for our property (in fact nobody does) can we go ahead and submit drawings and get planning permission without a Certificate of Habitation?
    If we cannot proceed, can we force our builder to provide a Certificate of Habitation?

    The builder is he one who has to obtain the Habitation Certificate. However, the Habitation Certificate is not needed to proceed with the extension of the property, since the project has to be written by an official arquitec or technician, and the licenses should be obtained from the Town Hall. The technician should make sure that the project is written according to the rules and regulations for the State, Community and Local and also that the works have all the requirements for Habitation.
