  • Building works with community approval----WHY?????

    FOUR Questions please.

If one has written agreement and no objection from their immediate neighbour to do some small building works, is it still necessary to get community approval.

Which Act in Spanish Law states that the community in an urbanisation should give their approval for building works.

If the community decides to denounce any individual and take someone to court have they the right to irresponsibly use community funds for legal action without the WHOLE community's agreement.

Which Act in Spanish Law defines what a community can or cannot do.

Some communities are going over the top in TRYING to make others' lives diificult.

    Thanks.

    1. It will depend on whether the works are to be carried out at private elements or communal and if they were against the general or particular rules that manage the community of owners.
    2. The Law applicable at the community of owners is called Horizontal Property Act (Ley de Propiedad Horizontal)
    3. The agreement has to be achieved by the majority of owners.
    4. Again the Horizontal Property Act defines what a community can or cannot do.
