    Predeterminado Resale of Off Plan COntract

    We purchased from Polaris in June 2004, due to unforeseen circumstances we are in a position where we have to sell on. The property should have been completed Spring 2006 but is still unfinished. Do we approach Polaris direct, who we think may offer to pay back the original part payment (approx. 45%) however this would mean we lose around 13,000. euro in mortgage repayments we have made to date. Would we be entitled to extra compension from Polaris. Advice on this and how we stand legally would be very appreciated. Thank you in advance for your assistance.

    Please note that when there is a delay in the hand over of a property, the law, according to Act 57/68, gives you faculties to ask for the cancellation of the contract with the right of getting the refund of the amounts paid plus the 6% interest from the date when the payments were released.
