Hi,
My wife and i jointly own too properties in La Florida. We separated 15 months ago and our divorce is due to be granted soon, as a result of the financial settlement she wants me to sign over ownership of both Spanish properties too her. The Value of property 1 is 84,000 Euros (my 50% Share = 42,000) property 2 is 140,000 Euros but has a mortgage off 132,000, she will take over full responsibility of the mortgage ( my 50% less mortgage = 4,000 Euros. Can you advise on the costs and taxes for transferring my 50% share of the properties, and also who pays the costs, would I have to pay just my own legal costs or would I have to pay some of the transfer taxes as well? Legal assistance is not required in that kind of transactions, having to contact a notary office in order to complete the settlement of the common properties. Transmission tax is 1%. however you should contact the bank in order to discuss about the assumption of mortgage loan by only one of you.
