  • Problem with communal pool ownership

We have bought a property which is in a block of eight houses, we have not formed a community yet as it has not been handed over by the builder. We have a problem with the end house which is attached to the communal pool, he has had two gates put into his garden directly into the pool area making it looks as though he owns the pool. We asked the builders to sort it out but even though they were furious he had altered the walls they are not willing to do anything. One of the neighbours has approached the owner direct but he can see nothing wrong in what he has done. Can anyone advise us what action we need to take to sort this out.

You need to find out whether he has actually done anything wrong! I know that to you and the other residents think it is wrong but it may be legal! This is Spain!!!!!!!!!!

What a sensible lad !! He's got to put up with the noise and agro of the pool being right next to him, he might as well have some extra benefit.

As long as he has not cut-off the main entrance to the pool.
It may become a problem if the pool is fenced off and he has created a new entrance to by-pass the secure entrance.
