can you please advise if it is normal practise to hand over power of attorney to a solicitor acting on your behalf even if you live and work in spain

  • #2
First of all we would like clarify that there are many different kinds of Powers of Attorney, as those used to purchase or sell a property and those used in front of the Courts of Justice.
On the one hand, in the first case Powers of Attorney are used to act on behalf of the person granting that Power, that is, the attorney is given some faculties by the grantor, so that the attorney could act on his or her behalf in for example signing a Title Deeds or arranging mortgages. If this is the case, the Power of Attorney is needed whenever the grantor is not going to be available to sign the relevant document on the appointed date.
On the other hand, the so called "Poder a Pleitos" is needed mainly to act on behalf of the grantor in front of the Courts of Justice in some proceedings, since there are other interventions in which the client does not need any representation.
