  • Death Duties on Property

I have read that to avoid paying ONE THIRD the value of a property in death duties to the Spanish government when a partner dies, you can form a company, get it registered and buy the property in the company's name, then if one of you dies the government cannot take death duties from the company.

    Is this correct?

We need to confirm the hypothetical case you are referring to. Please confirm whether your question refers to the case in which a property is owned by a Company (registered in Spain) and the company is owned by a couple. Are you asking whether there is any kind of bonification or exemption in the Inheritance Tax Form if one partner passes away and the other is the inheritor? Please advise as it is difficult to answer your question as it is not quite clear to us.
