Builder breached contract

We have instructed our Agent to formally request repayment of our deposit plus interest (as stated in our contract), as our off plan apartment has massively overrun. The builder is contractually obliged to repay this but how long is this likely to take and is it best to have a solicitor acting on our behalf to speed the process along?

The devolution of the amounts paid to date plus the 6% interest should be paid back once the cancelation of the purchase contract has been efectively communicated to you.
However, there is not a fixed established period of time to proceed. It is supposed it should be quick.

It is advisable to check with a solicitor in case they do not proceed accordingly with the devolution, once they have agreed to cancel the contract.
